General introduction

We take the protection of your personal data very seriously and want you to feel secure when visiting our website. Our data protection practices comply in particular with the provisions of the EU General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and the Telecommunications and Digital Services Data Protection Act (TDDDG). We would like to take this opportunity to inform you about the nature, scope and purpose of the processing of your personal data. Please note in advance that this privacy policy applies solely to our websites and does not apply to third-party websites to which we provide links.

Subject matter of protection

The subject matter of protection is personal data. This refers to all information relating to an identified or identifiable natural person (hereinafter referred to as the ‘data subject’). This includes, in particular, information that allows conclusions to be drawn about your identity (e.g. details such as your name, postal address, email address and IP address).

Technical requirements

In order for you to connect to our website, your browser transmits certain data to our website’s web server. This is a technical necessity to ensure that the information you have requested can be made available by the website. To enable this, your IP address, the date and time of your request and the type of operating system you are using, amongst other things, are stored and used for a maximum of 7 days. We reserve the right to store this data for a limited period to safeguard our legitimate interests, so that, in the event of unauthorised access or an attempt to deliberately cause us harm via this channel, we may trace the data back to personal data (Article 6(1)(f) of the GDPR). We will only retain or pass on this data for this purpose and no other, without first informing you and asking for your permission.

Cookies

Cookies are small text files stored on your computer or mobile device via your browser, for example to recognise whether you are visiting web pages repeatedly from the same device or browser. Generally, as the website provider, we use so-called first-party cookies to improve IT security or the user-friendliness of our website (Article 6(1)(f) of the GDPR). In accordance with Section 25(2) of the TDDDG, we may store cookies on your device or access data on your device if this is absolutely necessary for the operation of this site.

Cookies can usually be disabled or removed using tools available in most commercial browsers. The settings must be configured separately and individually for each browser you use. The various browsers offer different functions and options for this purpose.

When you visit our website for the first time, a pop-up window displaying our Cookie Consent Manager will appear. Types of cookies:

To explain the most common types of cookies in more detail, we have outlined them below for your understanding:

  1. Session cookies:
    Session cookies enable the website to recognise you and any changes you have made whilst on the site. They allow the website to track your movements across individual pages, so that information you have already entered or saved does not need to be re-entered or re-saved . An example of this is shopping baskets in online shops. The session cookie stores the selected products in the shopping basket so that it contains the correct items when you proceed to checkout. Session cookies are deleted when you log out or expire automatically once the session has ended.

  2. Persistent or protocol cookies:
    A persistent or protocol cookie stores users’ information and settings on the user’s computer for the period specified in the expiry date. This results in faster and more convenient access, as you do not, for example, have to reconfigure language settings or re-enter your login details. The cookie is automatically deleted at the end of the storage period.

  3. Third-party cookies:
    Third-party cookies generally do not affect the use of the website, as they do not originate from the website operator. Their purpose is, for example, to collect information for advertising, personalised content and web statistics, and to pass this on to the relevant third-party provider.

  4. Tracking cookies:
    Tracking cookies are special text files that enable data to be collected on the internet user’s behaviour. The aim is to gather information about the user’s areas of interest, for example to be able to launch tailored advertising offers. Tracking cookies are therefore not only set when you log in, but automatically whenever you visit the website.

Users of our contact form

Our website features contact forms that can be used to contact us electronically. To ensure the secure transmission of your data, we use a state-of-the-art encrypted connection with an SSL certificate during transmission. We store your name and email address, and any further information you provide, so that we can get in touch with you and respond to your enquiry as effectively as possible. This enables us, on the one hand, to provide you with the service you expect from us and, on the other hand, to continuously improve our services (Article 6(1)(f) of the GDPR).

Friendly Captcha

We use the ‘Friendly Captcha’ service provided by Friendly Captcha GmbH (Am Anger 3–5, 82237 Woerthersee) on our website.

The purpose of Friendly Captcha is to verify whether data is being entered on our websites (via the contact form) by a human or by an automated program (‘bot’). As part of this verification, the service processes your IP address, technical details regarding the browser and operating system used, the date and time of the request, and the section of the website from which the request originates. Any data you are asked to enter by Friendly Captcha during the verification process is also processed.

All data is stored only for as long as is necessary for the verification process. The data is subsequently anonymised or deleted.

The legal basis for processing the data is our legitimate interest pursuant to Article 6(1)(f) of the GDPR. Our interest lies in preventing unauthorised access and spam attacks by bots.

Use of Matomo

Our website uses Matomo, an open-source web analytics service. Matomo uses cookies to analyse the usage behaviour of visitors to our website. The information used for the purpose of website optimisation is stored in a cookie and transmitted to our server. Your IP address is immediately anonymised during this process, so that you, as a user, remain anonymous to us. The server is hosted by a service provider. The transfer of data for this purpose takes place on the basis of a data processing agreement in accordance with Article 28(3), first sentence, of the GDPR.

The cookie stores the following information:

  • browser type/version,

  • operating system used,

  • referrer URL (the previously visited page),

  • hostname of the accessing computer (IP address),

  • time of the server request


We use this data to measure the reach of our website. Before processing your information, we obtain your consent via our cookie consent manager (Article 6(1)(a) of the GDPR).

You may withdraw your consent at any time, free of charge and without giving any reason. In this case, a so-called opt-out cookie will be stored in your browser, which means that Matomo will not collect any session data. Please note: If you delete your cookies, this will also delete the opt-out cookie, which you may then need to reactivate.

Provided your browser supports the ‘Do Not Track’ feature and you have enabled it, your visit will be automatically ignored.

You have the option to prevent the actions you take here from being analysed and linked. This will protect your privacy, but will also prevent the site owner from learning from your actions and improving the user experience for you and other users.

Use of embedded YouTube videos

To embed videos on our website, we use YouTube, a service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland. The embedded videos will only work if you have previously consented to the processing of your data by YouTube via the plugin or our cookie consent manager in accordance with Article 6(1)(a) of the GDPR.

If you consent to processing by YouTube, a connection is established with Google’s servers. In doing so, various data, such as your IP address and information on user behaviour, are sent to the provider.

By using the service, it cannot be ruled out that your data may also be transferred to the USA. In principle, the transfer of your data is based on appropriate safeguards such as the EU-US Data Privacy Framework. However, the transfer of your data to the USA still entails certain risks; for example, national authorities may gain access to your data through domestic laws (such as the ‘FISA’), and your ability to exercise your data subject rights under Article 15 et seq. of the GDPR may be restricted.

If you do not wish to consent to the transfer of this information, please do not activate the YouTube plugin. This will allow you to continue using the site without any data being transferred. You may also withdraw your consent at any time with future effect.

Podigee Podcast Hosting

We use the Podigee podcast hosting service provided by Podigee GmbH, Schlesische Straße 20, 10997 Berlin, Germany. The podcasts are either loaded by Podigee or streamed via Podigee.

This is based on our legitimate interests, i.e. our interest in the secure and efficient provision, analysis and optimisation of our podcast service in accordance with Article 6(1)(f) of the GDPR.

Podigee processes IP addresses and device information to enable podcast downloads and playback, and to compile statistical data, such as the number of plays. This data is anonymised or pseudonymised before being stored in Podigee’s database, provided it is not required for the provision of the podcasts.

Data processing at LABOR.A

To take part in LABOR.A, you must first register on our event platform. The platform is provided to us by an external service provider (Talque). To ensure your data is processed securely, we have entered into a data processing agreement with the provider in accordance with Article 28(3) of the GDPR. When registering, you must provide the following information:

  • Surname, first name

  • Email address

  • Institution

  • Country

  • Participant category (speaker, moderator, participant, organising team, exhibitor)

Once you have been granted access to the event platform, a profile will be created using the details you have provided. You may choose to add a photo to this profile.

You may also choose to take part in a matchmaking session and specify your interests. Based on this, you will then be suggested other event participants with whom you can get in touch and network before and/or during the event.

If you wish to take part in a survey during the event, you can do so anonymously via a link or QR code.

Your data is processed on the basis of the consent you gave during the registration process in accordance with Article 6(1)(a) of the GDPR. You may withdraw your consent at any time with future effect. To do so, please send us an email to datenschutz[at]boeckler.de. In this case, however, you will no longer be able to take part in our event. You can delete any information you have provided on the platform in connection with the event yourself if required. To do so, you must delete your profile on the platform, which can otherwise also be used for other events. In this case, responsibility for data processing passes to the respective event organiser.

Online Submission Form:

If you wish to apply to us with a thematic contribution for LABOR.A, we provide an online form for this purpose. Depending on the type of submission, we have prepared three different forms for you. On the various online forms, we ask for the name and contact details of the contact persons responsible for the submission. We require this information for the purposes of selecting contributions and organising the event. The legal basis for data processing is the (electronic) consent provided on the form in accordance with Article 6(1)(a) of the GDPR.

Changes to this privacy policy

We review the privacy policy at regular intervals to ensure it complies with statutory provisions, case law and the guidance of supervisory authorities, and to ensure it is aligned with emerging trends and developments in technical standards. In this respect, we reserve the right to amend the privacy policy in order to bring it into line with new data protection legislation and other changes in the factual or legal situation. You should therefore always familiarise yourself with the privacy policy in force at the time you start using our website.

Who receives your personal data? (Art. 13(1)(e), (f) GDPR)

We treat your personal data as confidential and do not, as a rule, disclose it to third parties unless you have given your consent or the disclosure is required by law or under a contractual obligation. In isolated cases, we engage data processors to process your personal data. This is done in accordance with Article 28 of the GDPR and on the basis of a data processing agreement.

How long is the data retained? (Art. 13(2)(a) GDPR)

The legislator has laid down a wide range of retention obligations and time limits.

As a general rule, we only store your data for as long as is required by law.

Once these periods have expired, the relevant data is routinely deleted. We store data that we process on the basis of your consent until such consent is withdrawn or for as long as requires the data. We store data that we process on the basis of a legitimate interest for as long as that legitimate interest persists.

Where data is not subject to specific statutory retention periods, it will be deleted once the purposes for which it is processed no longer apply.

For what purposes and on what legal basis do we process your personal data? (Art. 13(1)(c), (d) GDPR)

We have already explained the purposes and legal bases for data processing. In addition, the following generally applies: where necessary, we process your data to safeguard our legitimate interests or those of third parties in accordance with Article 6(1)(f) of the GDPR, for example to assert legal claims and defend ourselves in legal disputes, or to ensure IT operations and security.

Where we have a legitimate interest or have obtained your written consent to the processing of your personal data, we process your data for the purposes of external communication and marketing on the basis of Article 6(1)(a) or (f) of the GDPR. You have the right to withdraw your consent at any time.

To comply with legal requirements, we may or must, where necessary, process your data and disclose it to third parties (in accordance with Article 6(1)(c) of the GDPR).

We do not use your data in any way for automated decision-making or profiling.

What rights do you have? (Article 13(2)(b), (c), (d) and (e) of the GDPR)

Every data subject has the following rights:

  • Under Article 15 of the GDPR, you have the right of access. This means you may request confirmation from us as to whether we are processing personal data relating to you. If we are processing personal data relating to you, you also have the right to receive a copy of that data.

  • Under Article 16 of the GDPR, you have the right to rectification. This means you may request that we rectify any inaccurate personal data concerning you.

  • Under Article 17 of the GDPR, you have the right to erasure (‘right to be forgotten’). This means you may request that we erase personal data concerning you without undue delay – unless we are unable to erase your data because, for example, we are required to comply with statutory retention obligations.

  • Under Article 18 of the GDPR, you have the right to restrict processing. This means that, apart from storing your personal data, we are effectively no longer permitted to process it.

  • Under Article 20 of the GDPR, you have the right to data portability. This means you have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format, and to transmit this data to another controller.

  • Under Article 7(3) of the GDPR, you have the right to withdraw your consent at any time with effect for the future.

  • Under Article 77 of the GDPR, you have the right to lodge a complaint with the relevant supervisory authority.

Information regarding your right to object under Article 21 of the General Data Protection Regulation (GDPR)

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(f) of the GDPR (data processing based on a balancing of interests); this also applies to any profiling based on this provision within the meaning of Article 4(4) of the GDPR.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims.
